1. Services Provided
Emalyn Inkz provides custom tattoo artistry services, consultations, and related services at our location:

We also provide appointment scheduling, booking, and communication services through our website and messaging systems.
2. Booking and Appointments
2.1 Booking Process
- Appointments may be booked through our website, by phone, or in person
- All appointments require a non-refundable deposit to secure your booking
- Deposits are applied toward the final cost of your tattoo service
2.2 Age Requirements
- You must be 18 years of age or older to receive tattoo services
- Valid government-issued photo ID is required at your appointment
2.3 Cancellations and Rescheduling
- Cancellations: If you need to cancel, please provide at least 48 hours’ notice. Deposits are non-refundable but may be applied to a future appointment within 6 months
- No-Shows: Failure to appear for a scheduled appointment without notice will result in forfeiture of your deposit
- Rescheduling: Appointments may be rescheduled with at least 48 hours’ notice. Multiple rescheduling requests may require an additional deposit
2.4 Late Arrivals
- Arriving more than 15 minutes late may result in shortened service time or rescheduling at our discretion
- Your full payment will still be required, or you may forfeit your deposit
3. Payment Terms
3.1 Pricing
- Final pricing is determined based on size, complexity, placement, and time required
- Estimates are provided during consultation but may be adjusted based on actual work performed
- Hourly rates and minimums apply and will be disclosed before service begins
3.2 Deposits
- Deposits typically range from $50-$200 depending on the project
- Deposits are non-refundable and must be paid at time of booking
- Deposits are applied to your final tattoo cost
3.3 Payment Methods
- We accept cash, credit cards, and debit cards
- Payment processing is handled securely through third-party payment providers
- Full payment is due upon completion of service unless otherwise arranged in advance
4. SMS/Text Messaging Terms
4.1 Consent to Receive Text Messages
By providing your mobile phone number and checking the SMS consent box on our booking form, you expressly consent to receive text messages from Emalyn Inkz at the number provided.
Messages may include:
- Appointment confirmations
- Appointment reminders
- Booking updates and changes
- Aftercare instructions
- Rescheduling notifications
- Promotional offers and updates (if you opted in separately)
4.2 Message Frequency
Message frequency varies depending on your appointment schedule and opt-in preferences.
You may typically receive:
- 2-5 messages per appointment (confirmation, reminder, follow-up, aftercare)
- Additional promotional messages if you have opted in (typically 1-4 per month)
4.3 Message and Data Rates
Standard message and data rates may apply based on your mobile carrier’s plan. Please contact your mobile carrier for details about your messaging plan.
4.4 Opt-Out Instructions
You may opt out of text messages at any time by:
- Replying STOP to any text message from us

- Requesting opt-out during any interaction with our staff
After replying STOP, you will receive one final confirmation message that you have been unsubscribed. You will no longer receive text messages from us unless you re-opt-in.
Note: Opting out of text messages does not cancel any scheduled appointments. You are still responsible for honoring your bookings.

4.6 Supported Carriers
Our text messaging service is available on all major U.S. mobile carriers including AT&T, T-Mobile, Verizon, Sprint, and many others. Mobile carriers are not liable for delayed or undelivered messages.
4.7 Privacy and Data Use
Your mobile phone number and text message data are subject to our Privacy Policy available at emalyn-inkz.com/privacy-policy/. We do not sell, rent, or share your phone number or text message opt-in data with third parties for their marketing purposes.
5. Health and Safety Requirements
5.1 Health Disclosure
You must disclose any medical conditions, allergies, medications, or health concerns that may affect the tattooing process. This includes but is not limited to:
- Blood disorders or bleeding conditions
- Skin conditions or diseases
- Diabetes
- Pregnancy or breastfeeding
- Compromised immune system
- Recent surgeries or medical procedures
- Use of blood thinners or certain medications
5.2 Contraindications
We reserve the right to refuse service if we believe tattooing may pose a health risk to you or if you fail to disclose relevant medical information.
5.3 Aftercare
You will receive aftercare instructions following your tattoo. Proper aftercare is your responsibility and is essential for healing and final results. Failure to follow aftercare instructions may result in infection, scarring, or poor healing.
6. Design and Custom Work
6.1 Custom Designs
- Custom designs are created specifically for your tattoo and remain the intellectual property of Emalyn Inkz until the tattoo is completed
- Design consultation is included in your service
- Significant design changes after approval may require additional fees
6.2 Design Approval
- You will have the opportunity to review and approve the design before tattooing begins
- Minor adjustments can be made, but extensive changes may require rescheduling
6.3 Inspiration and References
- You may provide reference images for inspiration, but the final design will be original artwork
- We do not copy other artists’ work
7. Touch-Ups and Corrections
7.1 Free Touch-Up Policy
- One complimentary touch-up is typically offered 4-8 weeks after your initial appointment
- Touch-ups are subject to proper aftercare being followed
- Touch-ups must be scheduled within 6 months of the original tattoo
7.2 Touch-Up Exclusions
Free touch-ups may not apply if:
- Aftercare instructions were not followed
- Excessive sun exposure occurred during healing
- You gained or lost significant weight affecting the tattoo
- Normal aging and fading over time (beyond the initial healing period)
8. Liability and Disclaimers
8.1 Assumption of Risk
You acknowledge that tattooing involves inherent risks including but not limited to:
- Pain and discomfort
- Bleeding
- Infection (if aftercare not followed)
- Allergic reactions to ink or aftercare products
- Scarring or keloid formation
- Dissatisfaction with artistic outcome
8.2 Limitation of Liability
To the fullest extent permitted by law, Emalyn Inkz, its artists, and Ink Myth Tattoo shall not be liable for any damages arising from:
- Your failure to follow aftercare instructions
- Pre-existing medical conditions not disclosed to us
- Allergic reactions or adverse skin reactions
- Your dissatisfaction with the artistic result after approving the design
- Normal healing variations and outcomes
8.3 Indemnification
You agree to indemnify and hold harmless Emalyn Inkz and Ink Myth Tattoo from any claims, damages, or expenses arising from your breach of these Terms or your failure to disclose relevant medical information.
9. Photography and Social Media
9.1 Photo Consent
By receiving services from Emalyn Inkz, you grant us permission to photograph your tattoo and use those images for:
- Portfolio display
- Social media marketing
- Website and promotional materials
- Before/after galleries
9.2 Opt-Out
If you do not wish to have your tattoo photographed or shared, please inform us in writing before your appointment. This will not affect the quality or availability of our services.
9.3 Your Tattoo Photos
You are welcome to photograph your own tattoo and share it on social media. We appreciate tags and credit to Emalyn Inkz.
10. Intellectual Property
10.1 Copyright
All original designs, artwork, and creative work produced by Emalyn Inkz remain the intellectual property of the artist. While you receive a permanent tattoo on your body, the design copyright remains with Emalyn Inkz.
10.2 Reproduction
You may not reproduce, replicate, or commercialize the custom design provided to you for purposes other than your personal tattoo.
11. Conduct and Behavior
11.1 Professional Environment
We maintain a professional, respectful, and safe environment. We reserve the right to refuse service or terminate an appointment without refund if you:
- Are intoxicated or under the influence of drugs
- Behave in a disrespectful, abusive, or threatening manner
- Violate health and safety protocols
- Bring unauthorized guests without prior approval
- Repeatedly arrive late or miss appointments
11.2 Guest Policy
Guests may be permitted with prior approval, subject to space availability and studio policies.
12. Website and Online Services
12.1 Use of Website
Our website is provided for information, portfolio viewing, and appointment booking. You agree not to:
- Use the website for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Transmit viruses or malicious code
- Collect information about other users

You agree to resolve disputes with us on an individual basis and waive the right to participate in class actions or class-wide arbitration.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Emalyn Inkz regarding your use of our services and supersede any prior agreements.
